What this document is. This EULA covers one narrow thing: the licence to install and use the Cycle Bloom Pal software on your device — what you may do with the app itself, and what belongs to us.
Everything else — your account, subscriptions and billing, the medical disclaimer, your data, our liability — lives in the Terms & Conditions and the Privacy Policy. If anything here conflicts with the Terms, the Terms win.
1. Parties and acceptance
This Agreement is between you (“you”) and Cycle Bloom Pal (“we”, “us”, “our”) — the licensor of the Cycle Bloom Pal application and its documentation and updates (the “Software”).
By downloading, installing or using the Software you accept this Agreement. If you do not accept it, do not install or use the Software, and remove it from your devices.
This Agreement is between you and us alone. It is not with Apple, Google, or any other app marketplace, and those companies are not parties to it.
2. Licence grant
We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to:
- install and use the Software on mobile devices that you own or control, and that the applicable marketplace’s rules permit; and
- use it for your own personal, non-commercial purposes.
On Apple platforms this licence is governed by Apple’s Usage Rules in the Apple Media Services Terms and Conditions, including any family-sharing or volume-purchase provisions. On Android, the Google Play Terms of Service apply to your acquisition of the Software.
The Software is licensed, not sold. You acquire no ownership in it.
3. What you may not do
Except where the law expressly says otherwise, you may not:
- copy, modify, adapt, translate or create derivative works of the Software;
- reverse engineer, decompile or disassemble it, or otherwise try to obtain its source code;
- rent, lease, lend, sell, sublicense, distribute or otherwise transfer the Software or your licence;
- remove, obscure or alter any copyright, trade mark or other proprietary notice;
- circumvent or disable any security, authentication, rate limiting or licensing mechanism;
- use the Software to build a competing product, or to train a machine-learning model;
- access the Software through automated means, or use it in any way not permitted by this Agreement or the Terms.
If you are in the EEA or the UK, nothing here restricts the rights you have under Articles 5 and 6 of Directive 2009/24/EC (or its national implementation) to observe, study or test the Software, or to decompile it for interoperability, where those conditions are met.
4. Ownership
The Software, its source and object code, design, user interface, graphics, text, the Cycle Bloom Pal name and logo, and all related intellectual property rights belong to us or our licensors, and are protected by copyright, trade mark and other laws. All rights not expressly granted in section 2 are reserved.
This Agreement does not affect ownership of your content — your logs, photos, measurements and reflections remain yours, on the terms set out in the Terms.
5. Updates
We may release updates, upgrades and patches. Your marketplace may install them automatically depending on your device settings. Updates are covered by this Agreement unless they come with their own terms, which we will show you. We may stop supporting older versions, and features may change or be removed — see the Terms for what happens if a paid feature is discontinued.
6. Third-party and open-source components
The Software includes third-party and open-source components, each licensed under its own terms. Those terms govern those components and, where they grant you rights broader than this Agreement, they prevail for that component. A current list of components and their licences is available on request from support@cyclebloompal.com.
The Software also relies on third-party services — including app marketplaces, sign-in providers and video hosts — whose own terms apply to your use of them. You agree to comply with those terms.
7. Not for medical use
The Software is a general wellness tool. It is not a medical device, and it is not contraception. It does not diagnose, treat, cure or prevent any condition, and its cycle predictions, nutrition estimates and AI-generated suggestions can be wrong.
Your licence does not permit using the Software for clinical decision-making, for diagnosing anyone, or as a means of preventing or achieving pregnancy. The full medical disclaimer is in section 3 of the Terms & Conditions, and it applies to this licence.
8. Subscriptions
Some features require a paid subscription. This Agreement does not grant access to them — it licenses the Software itself. Purchases, automatic renewal, cancellation and refunds are governed by section 5 of the Terms and by the rules of the marketplace that billed you.
9. Privacy
The Software collects and processes personal information, including health information, as described in our Privacy Policy. By using the Software you acknowledge that policy.
10. Term and termination
This Agreement runs until terminated. It ends automatically if you breach it, and you may end it at any time by deleting the Software from your devices. We may terminate or suspend the licence where you materially breach this Agreement or the Terms, giving notice and an opportunity to remedy where it is reasonable to do so.
On termination, stop using the Software and remove it from your devices. Deleting the Software does not delete your account or cancel a subscription — see the Privacy Policy and the Terms. Sections 3, 4, 7, 11, 12 and 13 survive termination.
11. Warranty and liability
The Software is provided “as is”, without warranties of any kind to the fullest extent permitted by law. Our disclaimers and the limits on our liability are set out in sections 13 and 14 of the Terms & Conditions and apply equally here — they are incorporated into this Agreement rather than repeated, so that one set of limits governs both.
Nothing in this Agreement excludes or limits liability where the law does not allow it, and nothing affects your statutory rights as a consumer.
We are solely responsible for providing any maintenance and support for the Software that we choose to offer or that the law requires. No marketplace has any obligation to provide maintenance or support.
12. Export compliance and restricted parties
You represent and warrant that:
- you are not located in a country subject to a government embargo, or that has been designated as a “terrorist supporting” country; and
- you are not listed on any government list of prohibited or restricted parties.
You will not use or export the Software except as permitted by the laws of your jurisdiction and of the jurisdiction in which the Software was obtained.
13. Governing law
This Agreement is governed by the laws applicable where Cycle Bloom Pal primarily operates, and the courts of competent jurisdiction have authority. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, and you may bring proceedings in your local courts.
14. Marketplace provisions
14.1 Apple
You and we acknowledge that this Agreement is between you and us only, and not with Apple, and that we — not Apple — are solely responsible for the Software and its content. Apple has no obligation to furnish any maintenance or support for the Software.
In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Software.
We, not Apple, are responsible for addressing any claims by you or a third party relating to the Software or your possession and use of it, including product liability claims, any claim that the Software fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy law, and any third-party claim that the Software infringes intellectual property rights. We are responsible for the investigation, defence, settlement and discharge of any such claim.
Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance Apple will have the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
14.2 Google Play
This Agreement is between you and us only, and not with Google. Google is not responsible for the Software, its content, or any claim relating to it, and has no obligation to provide maintenance or support. Your acquisition and use of the Software is also subject to the Google Play Terms of Service.
15. General
- If any provision is held unenforceable, the rest remains in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign this Agreement; we may assign it as part of a merger or sale of the business.
- This Agreement, together with the Terms and the Privacy Policy, is the entire agreement about the Software. Where they conflict, the Terms prevail.
- We may update this Agreement; material changes will be notified in the app or by email before they take effect.
